Regulations on participation in workshops, webinars and purchase of vouchers

  1. These Regulations define the terms and conditions of participation in workshops, hereinafter referred to as: Workshops, and also specify the terms and conditions of participation in webinars, hereinafter referred to as: Webinar, and the purchase of vouchers for workshops and webinars, hereinafter referred to as Vouchers, as well as information regarding order cancellation and rights withdrawal from the contract as well as the rules for submitting complaints. hereinafter referred to as: Regulations.
  2. For the purposes of these Regulations, the following terms have the following meanings:
    1. Store – online store operating at https://nataliadebarbaro.com
    2. User – a natural person with full legal capacity, a legal person or an organizational unit without legal personality who makes a purchase in the Store.
    3. Consumer – a natural person making a purchase in the Store in an area not directly related to his or her business or professional activity (in accordance with Article 221 of the Civil Code). All regulations relating to the User also apply to the Consumer, unless otherwise indicated in the Regulations.
    4. Organizer/Seller – Natalia de Barbaro-Modelska “Hekla” Burów 13 32-083 Burów, NIP: 6761021326
    5. Product – products offered in the Store, in particular Workshops, Webinars. which the User can purchase from the Seller via the Store.
    6. Workshops – a service consisting in the Seller conducting workshops in accordance with the description provided in the Store, which the User can purchase from the Seller via the Store.
    7. Webinars – a service consisting in the Seller conducting a webinar in accordance with the description provided in the Store, which the User can purchase from the Seller via the Store.
    8. Regulations – these regulations.
    9. Working day – a day from Monday to Friday, excluding public holidays.
  3. The entity organizing the Workshops and Webinars is Natalia de Barbaro-Modelska running a business under the company Natalia de Barbaro-Modelska “Hekla” Burów 13 32-083 Burów, NIP: 6761021326,
  4. The workshops will be held on the days and at the place determined by the Organizer.
  5. All workshops and webinars are described in detail on the website: https://nataliadebarbaro.com
  6. Sales of Workshops and/or Webinars are made without Users logging in.
  7. The parties to the sales contract for Products, Workshops and/or Webinars concluded via the Store are: the Seller and the User.
  8. The prices of Workshops and/or Webinars available in the Store are gross prices and are given in Polish zloty.
  9. Sales via the Store take place 24 hours a day, 7 days a week throughout the year, which does not exclude the possibility of temporarily disabling sales for technical reasons.
  10. Information about Workshops and/or Webinars along with the price presented on the Store’s website does not constitute an offer within the meaning of Art. 66 § 1 of the Act of April 23, 1964, Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended; hereinafter referred to as: Civil Code). This information, together with the price, presented on the Store’s website constitute only an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code.
  11. After deciding to participate in the Workshop and/or Webinar, the Participant is obliged to pay for his/her participation in order to confirm the reservation of a place in order to participate in the Workshop and/or Webinar. The given amount includes the fee for participation in a given Workshop or webinar, accommodation and meals. The user can do this:
    1. by selecting the appropriate Workshop and/or Webinar and adding it to the cart (“add to cart” button)
    2. filling in your contact details,
    3. acceptance of the regulations,
    4. getting acquainted with the information obligation,
    5. clicking the “buy and pay” button and making a payment via the link, bank transfer, payment card or Blik. Payment is made via the PayU system, owned and operated by PayU S.A. based in Poznań, 60-166 Poznań, ul. Grunwaldzka 186, with KRS number 0000274399, NIP number: 779-23-08-495.
    6. After making the payment in the system, the User is redirected to the order confirmation page.
  12. When the effective payment is made, a sales contract is concluded between the User and the Seller.
  13. All payment details are included in the confirmation of the initial booking received by the Organizer.
  14. The Participant may cancel his/her participation in the Workshops no later than 30 days before the planned start date of the Workshops referred to in point. 3 above. He is then entitled to a refund of the paid fee referred to in point 5 above, which will be refunded within 7 days of receiving an e-mail from the Organizer confirming acceptance of the reservation cancellation.
  15. In the event of cancellation of the reservation within 14 days before the planned start date of the Workshops referred to in point. 3 above, the amount paid referred to in point 5 above, is retained in the amount of 50% by the Organizer, and the existing reservation is canceled. The remaining 50% of the fee paid, referred to in point 5 above, will be refunded within 7 days of receiving an e-mail from the Organizer confirming acceptance of the reservation cancellation.
  16. In the event of cancellation of the reservation less than 14 days before the planned start date of the Workshops referred to in point. 3 above, the amount paid referred to in point 5 above, is retained by the Organizer and the existing reservation is canceled.
  17. The amount to be paid for participation in the Workshop is provided in the Workshop description available on the website nataliadebarbaro.com and on the Własny Pokoj page on Facebook in the “Events” tab, as well as in the e-mail sent by the Organizer confirming the initial reservation.
  18. The Workshop Organizer is responsible for organizing them.
  19. Travel costs to the Workshop venue are the own expense of each Participant. Participation in the Workshops does not include accident insurance (NNW).
  20. An adult person with full legal capacity may participate in the Workshop classes.
  21. Class participants are obliged to observe order, behave appropriately and express themselves in a way that does not disturb other people’s participation in the workshops.
  22. People under the influence of alcohol or drugs are strictly prohibited from entering classes.
  23. Participation in individual points of the Workshop program is not obligatory, with lack of participation due to reasons attributable to
    The Participant will not constitute a basis for demanding a reduction of the fee referred to in point. 10 above .
  24. The webinar is always held online, and the Participant will receive a link to it three days before the planned Webinar and on the day of the planned Webinar.
  25. If the Participant cannot participate in the planned Webinar online, he or she may receive a link to the Webinar recording after contacting the Organizer. The link is valid and active for seven days from the moment it is sent by e-mail to the Participant.
  26. The Organizer reserves the right to change the schedule or date of the Workshops in the event of extraordinary circumstances (e.g. illness of the instructor, epidemiological restrictions, random events, etc.) or in the event of failure to gather a sufficient number of Participants, about which the Organizer will inform Workshop participants in advance.
  27. The Organizer may cancel the Workshops before the planned event in the event of extraordinary circumstances beyond the Organizer’s control (including epidemiological restrictions) or in the absence of a sufficient number of Participants, of which the Organizer will inform the Participants by phone or e-mail. Then, the entire amount paid for participation in the Workshops will be refunded within 5 business days from the date of informing the Participant about the need to cancel the Workshops. Due to the cancellation of the Workshops, Participants are not entitled to any additional compensation claims.
  28. The Organizer is not responsible for accidents resulting from the failure of Participants to comply with these Regulations, applicable rules, program and recommended instructions.
  29. By participating in the classes, the Participant declares that he/she has up-to-date knowledge about the ongoing epidemic in Poland and is aware of the risks that participation in the away workshops may entail.
  30. By participating in the classes, the Participant declares that, according to his/her current state of knowledge, he/she is healthy, is not suspected of COVID-19 infection and has not had contact with a person infected with COVID-19.
  31. People showing symptoms of an infectious disease, subject to quarantine, isolation or epidemiological supervision cannot participate in the Workshops.
  32. All organizational issues, as well as details regarding the Workshops, are sent by e-mail at least 7 days before the start date of the Workshops.
  33. The Organizer and Participants undertake to maintain secrecy and full discretion regarding the course of the Workshops and the information they obtained about other Participants during the Workshops.
  34. All information and activities used during Workshops and/or Webinars are subject to copyright and protected under generally applicable laws.
  35. The User who is a Consumer has the right to withdraw from the contract concluded with the Organizer within 14 days from the date of conclusion of the contract. In order to exercise the right to withdraw from the contract, the User must inform the Organizer about his/her decision to withdraw from the contract by sending an e-mail to the following address: lucyna@nataliadebarbaro.com
  36. The deadline for withdrawal is deemed to have been met if, within the above deadline, the User sends the withdrawal from the Agreement by e-mail or sends the withdrawal form from the Agreement and receives its confirmation in accordance with the Consumer Rights Act. Such confirmation is sent to the e-mail address indicated as contact on the submitted declaration of withdrawal from the contract.
  37. If the Consumer participates in the Workshop and/or Webinar in accordance with Art. 39 of the Act on Consumer Rights, there is no right to withdraw from the Agreement.
  38. In the event of withdrawal from the Agreement, the Agreement is considered null and void.
  39. In the event of withdrawal from this contract, the Organizer returns the payment immediately, and in any case no later than 14 days from the date on which the User was informed about the decision to exercise the right to withdraw from this contract. The refund is made using the same payment methods used in the original transaction.
  40. The user may submit complaints regarding the services provided by Workshops and/or Webinars, or the purchasing process itself.
  41. The complaint should be sent to the Organizer’s e-mail address lucyna@nataliadebarbaro.com
  42. The complaint should include data enabling the User’s identification, the subject of the complaint and requests related to the complaint. In the event of receiving an incomplete complaint, the Organizer will call on the User to complete it, otherwise the complaint will not be considered.
  43. The organizer will respond to the complete complaint within 14 days from the date of receipt of the complaint.
  44. The Organizer operates in accordance with Polish law, including the Act of May 30, 2014 on consumer rights.
  45. Pursuant to Art. 13 section 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation data, hereinafter referred to as GDPR), we inform you that:
    1) The administrator of the Participant’s personal data is Natalia de Barbaro – Modelska
    2) The participant’s personal data are processed pursuant to Art. 6 section 1 letter b GDPR and Art. 6 section 1 letter f GDPR
    3) The purpose of personal data processing is the organization of workshops, the pursuit of possible claims related to the provision of services or defense against possible claims, settlement of participation in workshops
    4) The Administrator informs that providing personal data is a contractual requirement. Failure to provide personal data makes it impossible to conclude a contract
    5) The Administrator informs that each Participant has the right to access his/her personal data and correct and update them, as well as the right to transfer data, object to processing, limit processing and delete personal data, if there are legal grounds for this.
    6) The Administrator informs that the Participant’s personal data will be stored for the entire period of provision of services to the Participant, and the data will also be stored for the period of limitation of possible claims, including tax and civil claims.
    7) The Participant’s personal data will not be subject to automated decision-making, including profiling
    8) The Administrator informs that the Participant’s personal data may be made available only on the basis of applicable law
    9) The Participant’s personal data will not be transferred to a third country (i.e. outside the European Economic Area)
    10) The Administrator informs about the right to lodge a complaint with the body supervising the processing of personal data, i.e. the Personal Data Protection Office in Warsaw, ul. Rates 2
